Reservation Rental Agreement

ENTIRE AGREEMENT: This is a 4-page Rental Reservation Confirmation and Agreement which outlines the conditions and financial terms of your rental. No agreements made verbally prior to the execution of this Agreement shall be binding.
PERFORMANCE: This Agreement imposes an obligation of good faith in its performance and enforcement. If you default in performing any of the obligations herein, we shall be entitled to recover costs and expenses, including court costs and reasonable attorney
fees. This Agreement shall be construed to conform to the Chapter 509, Florida Statutes.
CHECK-IN/CHECK-OUT: Check-in time is 4:00 pm unless arrangements have been made prior to arrival. Check-out time is 9:00 am. Late check-out will be subject to additional rent of one day which will be deducted from your security deposit.
OCCUPANCY: Occupancy is limited to the number of people listed on your reservation. Exceeding the allowed occupancy will result in a breach and default under this Agreement and forfeiture of rents and security deposit. You may be required to vacate the premises
SMOKING: Smoking is NOT allowed inside this property. Butts are to be disposed of properly, not thrown on the ground, pea rock or canal. If cigarette butts are found on the property when you vacate an additional cleaning fee may be assessed.
PETS: No pets are allowed.
WIRELESS INTERNET: High speed internet service is available in this unit at no extra charge. All you need to do is turn on your laptop and set your Network Connections in your Control Panel to wireless connection. We are not responsible for any inability for
you to get on line either because issues of your computer or because of any outage from our cable company.
You are not to reconfigure, password protect, download or change settings on any of the equipment including the computer, modem or wireless unit. You will be charged at a rate of $100.00 per hour if a computer technician is needed.
CONDUCT: You and your party agree NOT TO DISTURB neighbors with loud noise or music or unlawful or unsafe behavior. If you allow or participate in such behavior, you will be asked to leave and will forfeit the remainder of your rental fee and deposits. Participation
in unlawful activities, including environmental destruction, natural resource violations, or public nuisance violations, may be cause for eviction.
INDEMNIFICATION: Marathon Vacation Rentals and its Owners shall not be liable for any loss, injury, death, or damage to persons or property which at any time may be suffered or sustained by lessee or by any person who may at any time be using or occupying
or visiting the leased premises or be in, on, or about the premises, whether the loss, injury, death or damage shall be caused by or in any way result from or arise out of any act, omission, or negligence of lessee or of any occupant, subtenant, visitor or
user of any portion of the premises, or shall result from or be caused by any other matter or thing. Lessee shall indemnify Marathon Vacation Rentals and its Owner against all claims, liability, and loss or damage whatsoever on account of any such loss, injury,
death, or damage. Lessee waives all claims against Marathon Vacation Rentals and its Owner for damages to the property or lessee in, on, or about the premises, and for injuries to persons or property in or about the premises, from any cause arising at any
INVENTORY: All rentals are equipped with linens, towels, cooking utensils, pots and pans, dishes, washer/dryer, barbeque grill, small appliances, coffee maker, etc. These items are inventoried by our housekeepers, upon your departure. You will be charged
for any broken or missing items.
CARE OF UNIT: You are responsible for maintaining the premises in a neat, sanitary condition. Please leave the keys and garage door opener on the kitchen counter top and leave the front door unlocked as you leave. Upon departure you are expected to leave the
property as you found it: tidy, garbage placed in outside trash containers, all lights and air conditioning turned off. Please do not rearrange the furniture. We expect to find only the last day’s linens and towels to be washed. You will be responsible
for any damage or loss to the rental property or for additional cleaning fees over normal wear and tear. You will also be responsible for lost keys and will pay $25.00 for any replacement.
RADON GAS: Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it overtime. Levels of radon that exceed federal and state guidelines have
been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your county public health unit. Pursuant to PP404.056(8), Florida Statutes.
TERMS OF PAYMENT:
Rent shall be paid 30 Days Prior to Check In.
A $500.00 deposit holds your rental until rent is due. Once you arrive, this $500.00 becomes a security deposit which covers any damage or loss that may occur to your rental during your stay. In no case is any part of the security deposit applied to rent due.
SECURITY DEPOSIT: Your security deposit will be deposited into a non-interest checking account and will be held until after you vacate and the property is inspected. If there is no damage or additional cleaning over normal wear and tear, you will be issued
a check which will be mailed to you within 14 days of your departure. If damage is found or additional cleaning is required, charges will be taken out of your deposit and the balance returned to you with a list of charges, if any. Please take care of our
home and there shall be no reason to use any part of the security deposit.
RENTAL RESERVATION: Your rental is conditionally reserved until your security deposit is received by us and funds clear the bank. Dishonored checks for deposit or rental shall be subject to a $25.00 processing fee for re-deposit.
CANCELLATION: If you cancel in writing up to 90 days before arrival, you will receive a full refund. If you cancel less than 90 days before arrival, your deposit and any prepaid rent will be refunded ONLY if we are able to procure another rental for that same
period. If no rental is procured, you will lose your deposit and any prepaid rent, not to exceed the amount of your rental.
REFUNDS: There are no refunds for late check in or early check out, bad weather, or illness. If federal, state, or local authorities call for an evacuation in the event of a tropical storm, a refund will be made from the date the evacuation is ordered.
SUBSTITUTION: If circumstances cause your confirmed unit to be unavailable (for example, if the unit is sold, damaged, or transient rental license is revoked), we will attempt to find comparable accommodations, subject to your approval. In the event we are
unable to find acceptable substitute accommodations, your deposit and prepaid rent will be refunded only for that period which you did not occupy a rental. We cannot, however, guarantee the confirmed rate in these circumstances.
RIGHT OF ENTRY: We, or any of our subcontractors, shall have the right to enter the property at any reasonable hour for the purpose of emergencies, making repairs or inspections.
